Customs Exemption Request
Definition
Obtaining customs exemption for raw materials, machinery, or spare parts after obtaining the industrial license.
Requirements
• A
valid industrial license.
• A
valid commercial registration for the factory.
Conditions
The agency must disclose to the investor all
available incentives and benefits, in addition to the conditions and procedures
for obtaining them.
The owner of the plant must review the
industrial database of local producers (industrial and local enterprises) to
verify that there is no local product capable of providing the required
quantities and specifications for materials and to avoid applying for customs
exemption if these local producers are available.
In the event that materials are available, the
owner of the plant is obliged to attach a letter of apology to three national
factories producing those materials (at least) stating that these factories are
unable to provide the industrial facility with the materials, equipment, or
spare parts required to be imported, with the necessity and importance of
matching the names and specifications of the materials in the apology letter
with the names of the materials in the exemption form.
If the Agency finds that none of these apologies are true or that there
are local manufacturers who are able to provide the machines, spare parts, or
materials required in the required quantities and specifications, the
application will be rejected.
The owner of the plant who obtains exemptions and incentives is
obligated to the following:
Do not abuse the incentives granted to him.
Initiation and continuation of work for which the incentives were granted
in accordance with the specified conditions.
The owner of the plant must submit certified financial statements of the
last fiscal year from a certified charted accountant.
Take all necessary steps to ensure that the demand for protected
industrial products is met.
Not to sell, waiver, or transfer incentives to another person without
obtaining prior written approval from the Ministry.
To submit to the Ministry what it requires of complete and correct data
about the project in the event that the product enjoys the incentives granted
to it.
Using machines, devices, spare parts, and raw materials included in the
customs exemption in the licensed plant for the purposes for which they were
exempted.
To establish a record for the registration of machines, equipment and
spare parts exempted from customs duties.
To establish a record for the entry of raw materials, semi-manufactured
materials, and imported packaging materials that are exempted from customs
duties.
The Minister or his delegate may withdraw all or some of the incentives
or exemptions granted to the plant in the following cases:
If the owner of the plant has obtained these advantages, exemptions, and
incentives as a result of providing false or misleading information or using
illegal methods.
If the plant stops production for a period of one year or has reduced or
changed its production capacity without justification approved by the agency.
The owner of the plant may appeal to the Minister against the decision to
withdraw all or some of the advantages, exemptions, or incentives within a
period of sixty days from the date of his notification thereof.
The investor must submit a request for customs exemption within a period
of not less than six months before import and not more than six months after
import.
