Freedom of Information Policy
This policy aims to govern and regulate the tasks and responsibilities related to the application of the freedom of information field managed by the Ministry of Industry and Mineral Resources and how it is implemented in the Ministry in a way that enhances the principle of transparency and the freedom to circulate this information in accordance with the freedom of information policy issued by the National Data Management Office and in compliance with all other relevant regulatory controls.
1. Scope
This policy applies to all requests from partners of the Ministry to view or obtain information managed by the Ministry of Industry and Mineral Resources that has been classified as freely tradable information according to the data classification policy approved by the Ministry of Industry and Mineral Resources.
2. Basic Principles
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to ensuring the application of the principles of Freedom of information, according to the Freedom of Data Policy issued by the National Data Management Office:
2.1. Transparency
This policy stipulates the individual's right to access information related to the general activities of the Ministry of Industry and Mineral Resources, in order to enhance the system of integrity, transparency, and accountability.
2.2. Necessity and proportionality
Any restrictions on the request to view or obtain protected information received, produced or handled by the Ministry of Industry and Mineral Resources must be clearly and explicitly justified in this policy.
2.3. The origin of public information is disclosure
The text of this policy considers the individual's right to access public, non-protected information. The applicant does not necessarily have to have a specific background or interest in this information to be able to obtain it, nor is he subject to any legal accountability related to this right.
2.4. Equality
The text of this policy states that all requests for access to or obtaining public information will be treated on the basis of equality and non-discrimination between individuals.
3. Freedom of information controls
The rights of the Ministry of Industry and Mineral Resources must be noted in the event of using this data.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to determining which data is made available to the public (open data) in accordance with the data classification methodology approved by the Ministry of Industry and Mineral Resources.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to verifying the identity of individuals before granting them the right to view or obtain information, in accordance with the controls approved by the National Cybersecurity Authority and relevant authorities.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to following and applying the controls of the Data Classification Policy and the Personal Data Protection Policy approved by the Ministry of Industry and Mineral Resources to all data access requests received from individuals.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources adheres to all relevant regulatory controls in managing requests, including those of the Cybersecurity Authority and the National Data Management Office.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to responding to data availability requests within the specified time period (30 days) to avoid any delay or non-response, provided that one of the following decisions is taken:
Approve the access request.
Reject the access request.
Approve the extension of the access request.
Notifying the beneficiary that the requested information is available on the entity's website or is not within its jurisdiction.
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to ensuring individuals rights regarding access to or obtaining public information, including:
The right to access and obtain any unprotected information held by any public entity.
The right to know the reason for the refusal to access or obtain the requested information
The right to appeal the decision to deny access or obtain the requested information
The Data Governance and Management Office at the Ministry of Industry and Mineral Resources is committed to notifying the individual - in an appropriate manner - if the application is rejected in whole or in part, explaining the reasons for the rejection and the right to appeal within a period not exceeding (15) days from the decision being made.
Individuals have the right to submit cases of non-response or grievances to the Governance and Data Management Office of the regulatory body for the industrial and mining sectors.
4. Responsibility of the Ministry of Industry and Mineral Resources
The Ministry of Industry and Mineral Resources is not responsible for any damage or misuse that may be incurred by entities or individuals as a result of using this data. The Ministry of Industry and Mineral Resources also does not guarantee the continued availability of the data or any part thereof. The Ministry of Industry and Mineral Resources also assumes no liability to users of this data, nor any damage or loss that may result from reuse of the data.
